ORDER OF PUBLICATION

COUNTY OF HARDY, TO-WIT:
The object of the above styled Civil Action is for the Petitioners to ask that a ruling be made by the Circuit Court of Hardy County to void and set aside a defective Deed, and to determine that, by virtue of the doctrine of adverse possession, the Petitioners are the fee simple owners of a tract of certain real estate located in Hardy County, West Virginia. In particular, the petitioners ask that from Alan Robinson, John Loomis, Lynn Tidwell, Barbara Mathias and Joel Mathias, as Trustees of the Mathias Brethren Church, were not the fee simple owners of the 0.0718 acres of land tract conveyed unto Sherri A. Loomis, by that certain Deed dated October 30, 2024 and of record in the Office of the Clerk of the County Commission of Hardy County, West Virginia in Deed Book 376, at Page 691; from said Trustees, and that said Mathias Brethren Church does not have any future cloud on this matters; and further that in consideration of the doctrine of adverse possession, the Petitioners (that being Sherri A. Loomis, Soter Joy Eberly, Cynthia Loomis, Jerrie Bonnie Hubbard, Lisa Branson, Candy Knopp and Andrew Merritt) should be deemed for the fee simple owners of a certain real estate containing 0.0718 acres (or 3,119 square feet), more or less, together with all rights and appurtenances with said tract being located in Lost River District, Hardy County, West Virginia.
A further basis for this Civil Action, is the fact that a Deed from Alan Robinson, John Sanderson, Tim Lloyd, Barbara Mathias and Ivan Mongold, as Trustees of the Mathias Brethren Church, unto Sherri A. Loomis, Soter Joy Eberly, Cynthia Eberly, Jerrie Bonnie Hubbard, Lisa Branson, Candy Knopp and Andrew Merritt, as the Heirs of Sherri A. Loomis, unto Sherri A. Loomis, a with said being dated October 30, 2024 and of record in the Office of the Clerk of the County Commission of Hardy County West Virginia in Deed Book 376, at Page 691, however, it has been found that the owners of said tract were inadvertently considered to be the aforesaid Trustees of the Mathias Brethren Church, and that said property was actually owned by George W. See, and his wife, Silas L. See, and Silas L. See, and Mary C. See, his wife. In consideration of same, it is unknown as to the Petitioners (that being Sherri A. Loomis, Soter Joy Eberly, Cynthia Eberly, Cynthia See, her heirs, or with whom their Heirs are.
It appearing, by Affidavit filed in this action, that more persons who may be persons who have an interest as more particularly described in the Petition and whose names and addresses are unknown to the Petitioners, it is hereby Ordered that each person which may have or have an interest in said property do appear and protect their interests. This matters is to be heard by the Honorable Judge Jason J. See, or his substitute Judge, namely James O. Heishman, whose address is 204 North Elm Street, Moorefield, WV 26836, on Monday, the 20th day of May, 2026, at 9:00 o’clock A. M. At the time of the execution of the Petition, or other defense to the Complaint filed in this action on July 24, 2024; otherwise, a copy of said Complaint will be made by the Circuit Clerk.
