The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 13, 2022, and duly recorded in the Office of the Clerk of the County Commission of Hardy County, West Virginia, in Document No. 230789, in Book No. 343, at Page 849, Logan P Strawderman and Cheyanne R Combs did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Rocket Mortgage, LLC, FKA Quicken Loans, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Hardy County Courthouse in Moorefield, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 01 – Capon District, Hardy County, West Virginia, and more particularly described as follows:
All those three (3) certain tracts or parcels of real estate, situate in the community known as “Arkansaw” in Capon District of Hardy County, West Virginia, and more particularly described in prior deeds in chain of title as follows:
“FIRST:
All that certain tract or parcel of real estate, together with all rights, rights of way, any and all improvements thereon and rights, interests, easements and appurtenances thereunto belonging or in anyway appertaining, situate in Capon District of Hardy County, West Virginia, containing 0.07 acres, more or less, and being more particularly described by metes and bounds description incorporated in that certain Deed to Roy Smith and Lee Mae Smith, dated July 16, 1974, and of record in the Office of the Clerk of the County Commission of Hardy County, West Virginia, in Deed Book No. 136, at Page 670, to which deed reference is hereby made for any and all pertinent purposes.”
SECOND:
All that certain tract or parcel of real estate, together with all rights, rights-of-ways, improvements and appurtenances thereunto belonging, situate in Capon District, Hardy County, West Virginia, containing approximately 1/4 of an acre, more or less, but assessed as 0.15 acre.
This real estate was more particularly described by metes and bounds description incorporated in that certain Deed to Roy Smith and Lena Mae Smith dated February 23, 1976, and of record in the aforesaid Clerk’s Office in Deed Book No. 141, at Page 149, to which deed reference is hereby made for any and all pertinent purposes.
“THIRD:
All that certain tract or parcel of real estate, together with all rights, rights-of-ways, improvements and appurtenances thereunto belonging, situate in Capon District, Hardy County, West Virginia, on the north side of the Little Ridge, and being roughly bounded and described in that certain Deed to Roy H. Smith of record in the Office of the Clerk of the County Commission of Hardy County, West Virginia, in Deed Book No. 83, at Page 98, as follows:
‘BEGINNING at a planted rock on the east side of the road leading from the Link Church to Charley Miller’s, thence S.E. up side of ridge 32 rods to a planted stone, thence about South 6 rods to a planted stone, thence N.W. 32 poles to said road, thence with said road about North 6 rods to the beginning, containing one and one-fifth acres (1-1/5) more or less.”
This real estate has been consolidated and assessed for real property tax purposes by the Hardy County Assessor’s Office as Tax Map 290, Parcel 0008, and described as being 1.42 acres.
The real estate herein conveyed is all of the same real estate which was conveyed unto the Grantors, by deed of RODNEY A. FUNKHOUSER and LISA M. FUNKHOUSER, husband and wife, dated the 7th day of December, 2022, and to be recorded in the Office of the Clerk of the County Commission of Hardy County, West Virginia, immediately prior to or contemporaneously with this instrument, and this is a conveyance in gross and not by the acre. Reference is hereby made to aforesaid deed and other documents therein referred to and same are incorporated herein, by reference, for all proper and pertinent reasons.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 771 Arkansaw Rd, Baker, WV 26801-8115.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
