Notice is hereby given that the following described real estate will be sold at public auction to the highest bidder at the front door of the Courthouse of Hardy County, in Moorefield, West Virginia, on Thursday, May 14, 2025, at 11:00 o’clock A. M.
Being all of that certain lot or parcel of real estate, together with all rights, of ways, easements, and appurtenances thereunto appertaining, situate, lying and being in the Moorefield District, Hardy County, West Virginia, being known as and designated as Lot Number 1 of Section 1, containing 1.37 acres, more or less, as shown on a plat of the “Asbury Heights Subdivision”, of record in the Office of the Clerk of the County Commission of Hardy County, West Virginia, in Map Book No. 1, at Page 19. Reference is here made to said plat for a more particular description of said real estate. Being the same real estate which was conveyed to Thomas Cyrus Rickard and Kristie N. Rickard, by deed from Thomas Cyrus Rickard and Kristie N. Rickard, his wife, by deed dated August 10, 2011, of record in the Office of the Clerk of the County Commission of Hardy County, West Virginia, in Deed Book No. 322, at Page 452.
TERMS OF SALE:

The property will be conveyed in an “AS IS” physical condition by Deed of Special Warranty, without any representation or warranty, express or implied, as to the condition of the property, the condition of the title, or any other matters, and subject to all matters of record, including, but not limited to, any and all reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, and conditions as may be found in the chain of title and any and all other matters affecting the subject property.

The purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

The Trustees under the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

The Trustees reserve the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustees.

The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to be ABANDONED PROPERTY AND WILL BE DISPOSED OF BY THE TRUSTEE.

The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
